Terms of Service

1. Acceptance of Terms

By accessing or utilizing the BioBitki web platform, REST API endpoints, Autodesk Revit BIM families, or automated bioclimatic site reports, you ("Customer", "Licensee", or "User") agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a company or other legal entity, you declare that you have the requisite authority to bind such entity.

2. Service Description

BioBitki Technologies provides algorithmic bioclimatic simulation, computational botanical matrix synthesis, and environmental compliance reporting (LEED, BREEAM, EU Taxonomy) for landscape architecture, municipal development, and civil engineering projects.

3. Commercial API Access & Fair Usage

• API Credentials: Customers must safeguard all generated API tokens. Any unauthorized usage occurring under client credentials remains the legal responsibility of the licensee.
• Rate Limiting: BioBitki enforces dynamic concurrency quotas to maintain system stability. Reverse engineering, DDoS simulations, or scraping the botanical taxonomy database without explicit consent is strictly prohibited.
• AI Compute Quota: Large-scale simulations utilizing our Claude 3.5 LLM reasoning pipelines are throttled according to the contracted subscription tier.

4. Intellectual Property Rights

All proprietary algorithms, neural botanical solvers, microclimate calculation engines, and Revit interoperability scripts remain the exclusive intellectual property of BioBitki Technologies (Founder: Mert YILDIZ).

Customers retain sole ownership of all customer-supplied CAD files, soil chemistry data, and project-specific architectural site geometries. Generated PDF specifications and IFC 4.3 BIM schedule outputs are licensed to the customer for direct commercial implementation.

5. Warranties and Technical Disclaimers

While BioBitki achieves industry-leading 99.8% simulation model precision based on historic meteorological reanalysis, biological outcomes are inherently contingent upon on-site execution, physical contractor planting fidelity, and localized weather anomalies. BioBitki provides all algorithmic recommendations on an "as-is" and "as-available" basis for certified landscape professionals.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall BioBitki Technologies or its founder be held liable for indirect, incidental, punitive, or consequential damages resulting from site implementation or agricultural supply shortages.
